SWEEPSTAKES IS OPEN ONLY TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND DISTRICT OF COLUMBIA, 18 YEARS OF AGE OR OLDER OR THE AGE OF MAJORITY IN THEIR STATE OF RESIDENCE, WHICHEVER IS OLDER. VOID IN PUERTO RICO AND WHERE PROHIBITED.


1. Eligibility: The Zatarain’s Mardi Gras House of Blues Sweepstakes (“Sweepstakes” or “Promotion”) is open only to legal residents of the 50 United States or District of Columbia age 18 and older or of the age of majority in their state of residence, whichever is older. Employees, officers and directors of Zatarain’s Brands, Inc. (“Sponsor”), Alcone Marketing Group (“Alcone”), HOB Entertainment, Inc. (“HOB”) and each of their respective parent companies, subsidiaries, affiliates, advertising and promotion agencies and entities involved in the design and implementation of the Sweepstakes and the immediate family members or members of the same household of such individuals are not eligible. "Immediate family" means parents, children, siblings and spouse and their respective spouses, regardless of where they reside. Void in Puerto Rico and where prohibited.

2. Sweepstakes Period: Sweepstakes begins on January 14, 2010 at 12:00:01 A.M. Eastern Time (“ET”) and ends on February 28, 2010 at 11:59:59 P.M. ET. Sponsor’s Sweepstakes computer is the official time keeping device for the Sweepstakes..

3. How To Enter: Visit http://www.zatarains.com and follow the directions to complete and submit the online entry form. Entries must be received by 11:59:59 P.M. ET on February 28, 2010. Limit of one entry per person or email address per day. In the event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed to be submitted by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person assigned to the email address by the organization responsible for assigning email addresses. Any attempt by any participant to obtain more than one entry per day by using multiple/different email addresses, identities or any other methods will void all that participant’s entries and that participant will be disqualified.

4. Drawing: A random drawing will be conducted in Saddle Brook, NJ on or about March 15, 2010 from among all eligible entries received by Alcone, an independent judging agency. Odds of winning the prize depend on number of eligible entries received.

5. Notification: Grand Prize winner will be notified by express courier (“Notification”) and will be required to complete, sign and return an Affidavit of Eligibility, a Liability Release and where permitted, a Publicity Release within the time specified in the notification letter. Failure by winner to timely return the completed documents or the return of any prize notification or prize as undeliverable will cause prize to be forfeited and awarded to a randomly selected alternate winner.

6. Prize/Approximate Retail Value (ARV): (1) Grand Prize: A check in the amount of $4,000 which may be used for a trip for winner and his/her family (up to four people total) to winner’s choice of any House of Blues location or for any other legitimate use determined by winner and winner’s choice, subject to availability and to artist restrictions, of (4) House of Blues concert tickets (to be awarded in the form of a voucher which will expire 12/31/2010) (ARV: $800). Voucher includes four (4) Foundation Room passes (if applicable; if chosen House of Blues location does not have Foundation Room, winner will not receive any substitute prize) and dinner for four (4) (excluding alcohol beverages) at the House Of Blues Restaurant. Total ARV: $4,800.

7. Prize Restrictions: No cash or other prize substitution in whole or in part except by Sponsor at its sole discretion for any reason for prize of comparable value. No prize transfers. Applicable taxes on prize and any expenses related to the acceptance and use of a prize and not specified in these Official Rules are the sole responsibility of the winner. Grand Prize winner will receive an IRS 1099 Form for the fair market value of prize.

8. General Conditions: By participating, entrants agree: (a) to be bound by these Official Rules and the decisions of Sponsor and judges which shall be final and binding in all matters relating to the Sweepstakes; (b) to release, discharge and hold harmless Sponsor, Alcone, HOB, and their respective affiliates, parent companies, subsidiaries, advertising and promotion agencies, and their respective shareholders, officers, directors, employees, representatives and agents (“Sweepstakes Entities”) from and against any and all liability, injuries, losses, damages, rights, claims and actions of any kind, including personal injury and/or death or property damage, sustained in connection with his/her participation in this Promotion, or from his/her receipt, possession, acceptance and/or use or misuse of the prize, or for any error in the announcement of any prize; and to ensure that all guests, or if a minor, said guest’s parent or guardian, provide similar releases of liability as set forth above; (c) that the foregoing Sweepstakes Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guaranty, expressed or implied, in fact or in law, relating to the prize; and (d) if winner, by accepting prize, to the use (except where prohibited by law) of his/her name, photograph and/or likeness by Sponsor or any party authorized by Sponsor for advertising, trade and promotional purposes in all media without review or additional compensation and, upon request, to provide such consent in writing.

9. Liability Limitations: Participation in Sweepstakes is subject to the Privacy Policy at http://www.zatarains.com/about/privacypolicy.aspx and Terms of Use at http://www.zatarains.com. IF YOU DO NOT AGREE TO THE PRIVACY POLICY OR TERMS OF USE, DO NOT ENTER THE SWEEPSTAKES, PROVIDE ANY PERSONAL INFORMATION ON THE WEB SITE OR OTHERWISE USE THE WEB SITE. Sponsor, its affiliates, subsidiaries, advertising and promotion agencies, agents and representatives and their respective officers, directors and employees are not responsible for and shall not be liable for: (a) printing or typographical errors in any Sweepstakes-related materials and in the event of any inconsistency between Sweepstakes-related materials and these Official Rules, these Official Rules shall govern and control, (b) electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties of any kind, including without limitation, server malfunction or any human error which may occur in the collection and processing of entries; (c) failed, incomplete, garbled or delayed computer transmissions; (d) lost, late, misdirected or incomplete entries or personal information; or(e) any condition caused by events that may cause the Sweepstakes to be disrupted or corrupted. Sponsor reserves the right, at its sole discretion, to cancel or suspend the Sweepstakes or any portion thereof should viruses, bugs, technical difficulties, suspected or actual electronic tampering, or other causes corrupt the administration, security, integrity or proper play of the Sweepstakes. In the event of cancellation or suspension, notification thereof will be posted at http://www.zatarains.com and the prize will be awarded in a random drawing among all eligible entries legitimately received immediately prior to the event(s) causing the termination or suspension. Sponsor, at its sole discretion, reserves the right to void any entries determined by Sponsor in its sole discretion to have been submitted fraudulently or in contravention of the Official Rules. Use of automated entry devices programs is prohibited. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. SPONSOR’S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THAT PROVISION. Sweepstakes, including construction, validity, interpretation and enforceability of these Official Rules shall be (1) governed by the laws of the State of Louisiana without regard to choice of law or conflict of law principles (whether of the State of Louisiana or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Louisiana; (2) any dispute, claims and causes of action arising out of or connected in any way with the Sweepstakes or the prize shall be resolved individually, without resort to any form of class action, and brought exclusively in a federal or state court in Louisiana; (3) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (4) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

10. Winners List/Official Rules: For the name of the Grand Prize winner, mail a self-addressed first class stamped envelope to: Zatarain’s Mardi Gras House of Blues Sweepstakes Winner P.O. Box 6614, Saddle Brook, NJ 07663 for receipt by March 31, 2010. For a copy of the Official Rules mail a self-addressed first class stamped envelope to: Zatarain’s Mardi Gras House of Blues Sweepstakes Rules, P.O. Box 6614, Saddle Brook, NJ 07663 for receipt by March 1, 2010; Official Rules will also be posted on http://www.zatarains.com.

11. Personal Information: The personal information collected through the Sweepstakes is subject to Zatarain’s Privacy Policy. By entering the Sweepstakes, you agree to the use of your personal information as described in the above Privacy Policy.
